Information about the processing of personal data by the General Data Protection Regulation, the so-called GDPR (RODO).

Due to the implementation of the = requirements of the Regulation of the European Parliament and the Council (EU) 2016/679 on the protection of individuals about the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation, hereafter: Regulation), A.C.P. notifies you about the principles of personal data processing:

 

 

Data Controller


The Controller of your personal data shall be A.C.P. Limited Liability Company located in Wola Gutowska 33E, 26-660 Jedlińsk, entered into the Register of Entrepreneurs kept by the District Court for Lublin-East in Lublin with its seat in Świdnik, VI Economic Department of the National Court Register under KRS number: 0001008412, NIP: 7963015252, REGON: 523931529, contact phone: +48 790 353 566, email: rfq@anodownia-radom.pl, hereafter referred to as "Controller".

 

Data Protection Supervisor


The Controller has appointed a Data Protection Supervisor, namely Mr. Pawel Waniek. He can be contacted via e-mail address: biuro@paod.pl or in writing (to the Controller's registered office address). The Data Protection Supervisor can be contacted on all matters concerning the processing of personal data and the exercise of rights related to data processing.

 

Categories of personal data


The notice applies to personal data obtained by means other than directly from the data subject.

The administrator processes the following categories of data: identification data, address data, and contact data.

 

Purposes and legal basis for processing personal data

 
Personal data may be processed by the Controller for the following purposes:

  1. carrying out the recruitment process / and future recruitments - the legal basis for the processing of personal data in this regard is your consent, i.e. Article 6(1)(a) of the Regulation, and the Controller’s fulfillment of its legal obligations, i.e. Article 6(1)(c) of the Regulation in connection with the provisions of the Labor Code;

  2. to execute the employment contract concluded with you or to take necessary actions prior to the conclusion of the contract - the legal basis for processing personal data in this scope is Article 6(1)(b) of the Regulation;

  3. fulfillment of legal obligations imposed on the Controller in relation to the conclusion of an employment contract with you (writing up statements required by law, human resources and payroll services, calculation and execution of salary payments, issuing occupational health and safety training cards and periodic occupational health and safety certificates). - the legal basis for the processing of personal data in this scope is Article 6(1)(c) of the Regulation;

  4. to grant you benefits from the Company Social Benefits Fund - the legal basis for processing your personal data in this regard is your consent, i.e. Article 6(1 (a) of the Regulation;

  5. for processing for statistical and internal reporting purposes - the legal basis for processing personal data in this regard is Article 6(1)(f) of the Regulation;

  6. promotion and marketing concerning the activities carried out by the Controller during the term of the contract - the legal basis for the processing of personal data in this scope is the legitimate interest of the Controller, i.e. Article 6(1)(f) of the Regulation;

  7. promotion and marketing concerning the activities carried out by the Controller after termination, expiration, or withdrawal from the contract - the legal basis for the processing of personal data in this scope is the consent of the data subject, i.e. Article 6(1)(a) of the Regulation;

  8. to establish and pursue its claims or defend against claims raised - the legal basis for processing personal data in this scope is the legitimate interest of the Controller, i.e. Article 6(1)(f) of the Regulation.

 

Information about the periods of processing personal data

 

The Controller will retain your personal data:

  1. for the period necessary for the recruitment process/for the period necessary to complete this recruitment process and for future recruitments;

  2. to enter into a contract and for its execution - for the duration of the contract, and thereafter for the period and to the extent required by law, as well as for the period necessary to establish and assert its claims or defend against any claims put forth;

  3. for processing for statistical and internal reporting - until the legitimate interest of the Controller forming the basis for such processing is fulfilled, or until you raise an objection;

  4. for the promotion and marketing activities carried out by the Controller during the term of the contract - until you raise an objection;

  5. for the promotion and marketing of the Controller’s activities after termination, expiration, or withdrawal from the contract - until you withdraw your consent;

  6. to establish and assert one's own claims or defending against claims raised - until the statute of limitations applies for potential claims under the contract or on other grounds;

  7. for the purposes of compliance with legal obligations imposed on the Controller - for the period in which the law requires the Controller to keep records and to fulfill any obligations towards you arising from such provisions.

 

 

Monitoring


The Controller uses video surveillance to protect property and ensure the safety of people within the monitored area. The basis for processing is the Controller's legitimate interest, i.e. Article 6(1)(f) of the Regulation. The monitoring records will be stored for up to 3 months. A person recorded by the monitoring system has the right to access the recording through an entity authorized under applicable law, e.g. the Police. A person recorded by the monitoring system has the right to file a complaint with the Personal Data Protection Office.


Information on recipients of personal data

The data is provided to the Controller and may be transferred to the following recipients:

  1. entities or bodies to which the Controller is legally bound or authorized to provide access to the personal data based on commonly applicable laws, including entities or bodies authorized to receive personal data from the Controller or authorized to request access to personal data based on commonly applicable laws;

  2. entities participating in the recruitment process/future recruitment processes on behalf of the Controller;

  3. entities participating in the processes necessary for the execution of the employment contract concluded with you;

  4. entities processing your personal data on behalf of the Controller based on an entrustment agreement concluded with the Controller for the processing of personal data.

 

Automated decision-making, including profiling

 
Profiling is to be understood as any form of automated processing of personal data that involves the use of personal data to assess certain characteristics of an individual, in particular, to analyze or forecast aspects of that individual's work, economic situation, health, personal preferences, interests, reliability, behavior, location or movement.

With the above in mind, A.C.P. Limited Liability Company informs that it does not carry out profiling of data subjects.


Rights of the data subject

 
You have the right to access your personal data, including obtaining a copy, the right to request rectification, deletion (right to be forgotten), and restriction of processing by the terms of the Regulation.

You have the right to object to the processing of your personal data to the extent the processing of your personal data is based on the premise of the legitimate interest of the Controller.

Provided that the basis for the processing of your personal data is consent, you have the right to withdraw your consent. Withdrawal of consent does not affect the legality of processing that was carried out based on consent before its withdrawal. To the extent that your personal data are processed to enter into and perform a contract or processed based on consent - you also have the right to data portability, i.e. the right to receive from the Controller your personal data, in a structured, commonly used machine - readable format (you may send this data to another Controller) and the right to request a direct transfer of your data by A.C.P. Limited Liability Company to another Controller if technically possible.

To the extent that your personal data is processed for the promotion and marketing of the activities carried out by the Controller you have the right to object at any time to the processing of your data for the promotion and marketing of the activities carried out by the Controller, including profiling, to the extent that the processing is related to the promotion and marketing of the activities carried out by A.C.P. Limited Liability Company.

You also have the right to submit a complaint to the authority overseeing the compliance with the Regulation, i.e. the President of the Personal Data Protection Authority, if there is a suspicion that the processing of your personal data violates the provisions on personal data protection.


Source of data

This notice applies to personal data obtained by means other than directly from the data subject.
 
Your data may come from the principal (if given authorization), statutory representative, as well as publicly available sources (such as databases and registers: REGON, Central Register of Economic Activity (CEIDG), National Court Register (KRS)).


Transfer of personal data to a third countries


The Administrator does not share your personal data with entities located outside the European Economic Area (EEA).
 
 

Obligation to provide personal data

 
Your submission of personal data is voluntary, however, it is a condition for the conclusion and performance of the contract and statutory rights and obligations of the Controller related to the performance of the purposes referred to above. In case of failure to provide personal data, the Controller is forced to refuse to enter into a contract. To the extent that personal data are collected based on your consent, providing personal data is voluntary.
